In a landmark legal decision, a federal district court judge held that the Village of Flower Hill, New York acted in its authority to deny 18 “small cell” 4G wireless antennas on public rights-of-way in Flower Hill. A telecommunications company working for Verizon Wireless, ExteNet, Inc. (“ExteNet”), lost their federal lawsuit against the Village which claimed that the Village’s ordinance regulating small cell facilities constituted “an effective prohibition” on personal wireless services and other aspects of the Telecommunications Act (“TCA”) of 1996.
