EHT Files Writ of Mandamus to Force FCC and FDA Compliance with Historic RF Radiation Court Ruling

The Environmental Health Trust (EHT) has announced a major legal development in the ongoing battle for accountability over wireless radiation safety standards in the United States.

On 18 May 2026, EHT and co-petitioners filed a Complaint for Mandamus with the Washington, DC Circuit Court, demanding that after five years of delay the court compel the Federal Communications Commission (FCC) and the Food and Drug Administration (FDA) to comply with the court’s landmark 2021 ruling regarding radiofrequency radiation exposure guidelines.

According to EHT: “The FCC and FDA have been served with the Writ and now have 60 days to take action: either to comply with the original court order or to explain why they have not.”

The action follows the historic 2021 court decision in which the U.S. Court of Appeals for the D.C. Circuit ruled that the FCC failed to adequately explain how its wireless radiation exposure limits protect against evidence of harm, particularly for children and the environment.

EHT President and General Counsel stated: “It is telling that most civilized countries whose scientific and health agencies have studied wireless radiation exposure have dramatically reduced their exposure levels to 10 percent or less of the levels in the United States. The ongoing harms to humans, and especially children, let alone flora and fauna, is scandalous, and history will not be kind to those who prevented compassionate and common sense reforms. This is important because the industry could easily compete on safety and produce safer networks and devices, as is being done in other countries.”
