A mixed decision: further documents become accessible, but the algorithms remain under wraps
Press release — xxxx November 2026
How does an iPhone adjust its transmission power during specific absorption rate (SAR) tests? In an opinion dated 29 October 2026, France’s Commission on Access to Administrative Documents (CADA) denies Phonegate Alert access to documents describing the iPhone 12 algorithms and to technical files for iPhones sold since 2019. The reason: trade secrets. Another obstacle to transparency in the smartphone Dieselgate scandal.
No access to the algorithms
On the central issue, the door remains closed. Yet in December 2025, CADA itself recognised that SAR data constitute environmental information. Trade secrecy cannot be invoked to deny access to such information. How can tests be scrutinised if the software influencing the measurements remains secret?
But another step forward
CADA grants us access to several important documents: exchanges between France’s National Frequency Agency (ANFR), Apple and the European Commission about the iPhone 12, as well as notes and meeting records concerning its continued presence on the market. We immediately requested them from ANFR.
ANFR contradicted by its own documents
ANFR claims that its exchanges with Apple and laboratories concerning iPhones do not exist. CADA took its word for it.
Yet the agency itself states in writing that it has had 25 Apple devices tested in laboratories since 2012. Its testing specifications require written exchanges for every test. They provide for algorithms to be supplied to the laboratories.
Any exchanges with health authorities before the iPhone 12 was withdrawn from the market? None, according to ANFR.
Where are these documents?
“We will bring the full facts to light”
“We face another obstacle. ANFR declares that documents do not exist, even though its own written statements attest to them. Market surveillance and public health cannot depend on algorithms kept secret. With your support, we will bring the full facts to light.”
Dr Marc Arazi, President of Phonegate Alert
The legal battle continues
We have asked ANFR to provide without delay the documents to which CADA granted access, and to explain its position on those it claims do not exist. We have also written to CADA.
