In the United States, two public consultations have been launched. The Federal Communications Commission (FCC) is examining radiofrequency exposure standards and regulatory oversight. Meanwhile, the United States Department of Health and Human Services (HHS) is reviewing scientific evidence and health risks. On October 21, 2026, the NGO Phonegate Alert responded to both consultations by submitting a joint dossier of 58 pages, including annexes.
Nearly ten years of investigations, evidence and warnings are now available to US authorities, organizations, scientists, journalists and the public.
At the heart of the dossier: Smartphone Dieselgate
Proprietary algorithms automatically modify the transmission power of smartphones during testing. As a result, they affect the conditions under which the Specific Absorption Rate (SAR) is measured. Yet manufacturers provide no real transparency about these mechanisms. Moreover, market surveillance authorities cannot independently verify how they operate. Declared compliance therefore does not guarantee users’ actual exposure levels.
Europe has begun to act. The Apple iPhone 12 case led to decisions by the European Commission in 2025. Subsequently, this case led to changes in measurement standards in September 2026.
“As in the automotive Dieselgate scandal, software plays a role in regulatory testing. Our NGO calls for reliable exposure measurements, independent testing, a reassessment of health risks and sanctions against manufacturers responsible for manipulating regulatory tests. The evidence is on the table. US authorities must act. Manufacturers must answer for their practices.”
