Looking for additional legal strategies to stop 5G infrastructure (small cells – both 4G and 5G) in your area?

The FCC has been directed by a federal judge to conduct a NEPA (National Environmental Policy Act) Review, not conducted prior to the rollout of 5G infrastructure (FCC 18-133 — the Small Cell Order), per FCC’s judgement that it did not need to do so, as FCC incorrectly self-determined that 800,000 “small cell” poles would not impact the environment.

It has been suggested that thus, until this NEPA review is conducted by FCC, one might legally demand that all small cells allowed to be installed be deactivated, in progress with current applications, or future applications be paused and shot clocks stopped – or outright rejected. Local NEPA reviews might also be demanded of all applicants for EACH small cell, with shot clocks stopped, and if contested, remanded to the FCC for a determination on EACH small cell.
